No. Frivolous lawsuits happen all the time and the plaintiff always get stuck with the legal fees. I think that's a pretty solid deterrent as far as checks and balances go. Also, while there are a lot of lawsuits filed in life, one thing that's truly fantastic at keeping things in check is the perceived fear of lawsuits. I'm not going to do anything stupid because I don't want to get sued, and I'm going to do things by the book instead of haphazardly. If we didn't have such a litigious system, individuals and companies would lose much of the incentive to be careful and act ethically in a lot of situations.

If you read this article by George Will, you will agree there are too many lawsuits over truly stupid things, and people are scared to breathe for fear of being sued. Here are a few of the examples:

America has more lawsuits and more lawyers than any other country.
Over a million lawyers, over 16 million civil cases in State courts in 2002.
87% of all Americans think people sue as if they are playing the lottery.
Frivolous lawsuits cost us $2oo BILLION each year.
A huge reason health care costs are so high is because of the giant ammount of lawsuits filed against doctors, hospitals, and drug companies.
My personal favorite is the folks who sue McDonald's for making them fat.
