What would be an appropriate punishment for a mother who drinks and drives with her two children in the car?
A 30-year old woman drove dunk and disorderly through Hennepin county, MN while trying to escape the police car following her. In the four mile chase through traffic, the woman almost crashed into other vehicles and almost landed herself in a nearby ditch. Her blood alcohol level as three times the legal limit. While driving under the influence of alcohol, she had her two small children ages 2 and 4 in the car with her. What should happen to this mother, according to your opinion?

She should receive jail time of about a week. During that time she should go through a short counseling program that will maybe make her think about what she did. The counseling should have pictures and stories of children who were the victims of a drunk driver and who died because they were in a car being driven by a drunk driver.
She had an open bottle of rum in a diaper bag and marijuana on the front seat of her car. On second thought, maybe foster care would be a better option for the kid's sake. This probably wasn't a one time occurrence.

Alcohol appears to have had nothing to do with this crime.
She should lose her license, but since she has already been convicted four times for driving without a license this will likely make no difference. Her car could be seized and she should be prevented from registration another car, but it is likely she does not own the car and hence seizing the car will likely make no difference. The only other option left is prison time. She should receive a prison sentence, more details would need to be know to decide what length of prison sentence would be required to improve her behavior.

This woman should receive the punishment that is handed down to any other person who fled to evade capture, engaged in reckless driving, drove under the influence, and caused child endangerment.
I do not believe that the letter of the law should be a fluid thing which can be watered down or intensified merely due to the emotions that emerge from a particular crime. Laws are supposed to ensure society fair and equal justice precisely because they are secular of emotion.
One thing which the law would most probably result in for this case, would be the removal of the children from this mother. If she harbors any true maternal bonds, that should strike her like a cold blade through the heart, far more even than the years in prison which she should also serve.
Punish her as the law states; nothing less, but likewise, nothing more.
